    Course Objectives This course aims to teach the procedures and principles of individual application to the Turkish Constitutional Court and the European Court of Human Rights, accompanied by sample court decisions.
    Learning Outcomes

    The students who succeeded in this course;

    • define the right of individual application to the Turkish Constitutional Court and the European Court of Human Rights.
    • explain the admissibility conditions of individual application to the Turkish Constitutional Court and the European Court of Human Rights.
    • explain the merits review phase of the individual application to the Turkish Constitutional Court and the European Court of Human Rights.
    • compare the fundamental rights and freedoms in the 1982 Constitution with the European Convention on Human Rights and Additional Protocols to the Convention.
    • discuss the issue of judicial protection of fundamental rights and freedoms.
    Course Description In the course, the role of individual application to the Turkish Constitutional Court and the European Court of Human Rights in protecting fundamental rights and freedoms is explained and the individual application method is discussed in detail in the light of the 1982 Constitution, relevant legislative provisions and the decisions of the Constitutional Court and the European Court of Human Rights
