    Course Objectives It is aimed with this course to evaluate the effects of expanding subcontracted work in enterprises on the rights of labour and labour law as a whole mutually in the light of international and national legislation.
    Learning Outcomes

    The students who succeeded in this course;

    • Students will be able to;
    • Define the basic principles of labour law differentiate it from Law of Obligatons,
    • Discuss interaction between labour law and subcontracting becoming prevalent in the scope of new employment types characterized with outsourcing in the world and Turkey,
    • Give information about Turkish legislation and case law related with employment via subcontractor ,
    • Evaluate the effects of subcontracting practice on labour rights and basic principles of labour law,
    • Examine the debates about draft law with assumed changes on existing legal rules regarding subcontracting within the scope of both international and comparative law.
    • Interpret the impact of subcontracting on fundamental human rights and freedoms associated with social rights and bring forwards proposals.
    Course Description The content of this course consists of the impacts of ‘’subcontractor’’ on Labor Law and labor rights both in the World and Turkey. Basic topics of this lesson are theconcepts of employee, employer and subcontractor in Labor Law, employer and employee’s rights and obligations which arises from employment contract and the impacts of subcontractor on these rights and obligations, legal provisions of subcontractor and simulation, effects of subcontractoring on fundamental rights and freedoms and social rights in the framework of fundamental principles of Labor Law.
