Course Objectives The aim of this course is to examine the rules that distribution agreements are subject to in terms of sanctions and exemptions within the scope of the Turkish Competition Law regime, the framework of which is determined by the Law No. 4054 on the Protection of Competition, and in the light of the Competition Authority Decisions.
Learning Outcomes The students who succeeded in this course;
  • will be able to compare the concepts of competition, unfair competition and non-competition.
  • will be able to explain the transactions and actions that constitute a violation of competition within the framework of the Competition Law regime.
  • will be able to analyze the consequences of competition violations in terms of private law in the light of general principles of liability.
  • will be able to classify distribution agreements from various perspectives and explain their features.
  • will be able to evaluate the sanctions and exemptions to which distribution agreements are subject in the light of competition violations.
Course Description Within the context of this course, following the examination of the basic concepts of competition law, violations of competition and their consequences in the field of private law the effects of distribution agreements on competition and the regime to which they are subject in Turkish Competition Law, the framework of which is determined by the Law on the Protection of Competition No. 4054, in terms of sanctions and exemptions will be discussed.
