Course Objectives The ultimate goal of this course is to know what the fundamental rights are in cases relating to private law and also know how to protect them. Therefore, we must examine the legal texts and tools (constitution, European Convention on Human Rights etc..) and their applications. As the cornerstone of the way of individual application (constitutional complaint) before the Constitutional Court, the case law of the European Court of Human Rights also provides a vast and rich source. In the light of the European Convention on Human Rights, the fundamental rights, which should be protected in the private law disputes, will be examined in connection with the case law related articles. Thus, we obtain the necessary knowledge on the possibilities to uphold human rights in international law concerning cases of private law.
Learning Outcomes The students who succeeded in this course;
  • Students who successfully complete this course will be able to;
  • Describe the role and function of European Court of Human Rights
  • Analyze the role of the Constitutional Court in the field of individual applications
  • Understand how the admissibility criteria is considered
  • Describe the scope of various civil rights and the relationship between the human rights and private law disputes.
  • Explain the meaning of concepts such as “determination of his civil rights and obligations, “an independent and impartial tribunal established by law”, “in a democratic society” and
  • Understand the importance of some principes in the concept of “Right to a fair trial” ( The right of access to court, adversarial proceedings and equality of arms)
Course Description The mechanism of individual applications; Convention for the Protection of Human Rights and Fundamental Freedoms in the field of private law; special convention expressions, like “determination of his civil rights and obligations”; procedural rights; Binding force and execution of judgments.
