Course Objectives The objective of this course is to examine the employment (service) contracts’ parties’ fundamental rights arising from the contract.
Learning Outcomes The students who succeeded in this course;
  • Explain the fundamental rights arising from the employment (service) contract,
  • Define the problems regarding fundamental rights arising from the employment (service) contract,
  • Classify the problems regarding fundamental rights arising from the employment (service) contract,
  • Compare the atypical employment relationships, and their impacts on the fundamental rights,
  • Discuss the issues encountered in practice, regarding fundamental rights arising from the employment (service) contract.
Course Description Within the scope of this course, the fundamental rights arising from the service relationship, such as the employer’s right to govern and its limits, duty of care of the worker, the worker’s duty of loyalty, non-compete agreements, the worker’s private life and protection of personal data, mobbing (psychological harassment), syndical rights, obligation of equal treatment will be examined.
